Taiwan's Labor Law Revisions Take Effect May 1

On the first of May, revisions to three labor laws in Taiwan went into effect, giving greater protection to the country's workers, according to the country's Council of Labor Affairs (CLA).

The changes cover amendments to the Collective Bargaining Agreement Act, Settlement of Labor Disputes Act, and Labor Union Act.

While previous rules required unions to be formed only by employees working in the same company, the new rules allow workers at different firms to organize unions, giving workers greater collective bargaining power, says CLA Deputy Minister Pan Shih-wei, adding that foreign workers will also be able to serve as union leaders.

Shih-wei also says that the CLA will offer financial subsidies to encourage the formation of unions throughout the country.

Also, school teachers, who previously were considered a special class of workers not covered by the Labor Union Act, can now organize unions.

There are already plans to unionize among electronics and electrical works in the Hsinchu Science Park, as well as employees in the telecommunications sector. Teachers in the New Taipei, Taichung, Tainan, and Kaohsiung cities all created labor unions on May 1st.

The CLA deputy minister urged corporate management teams to respond positively to employee efforts to form labor unions, and cautioned that any mistreatment of workers participating in labor-forming activities would be subject to strict penalties.
