CHINA: Employment contracts must be registered

Employees must register contracts that are above county level with the Chinese labor and social security departments, and employers must register all employment contracts with local authorities, effective January 2007.

Provisions of the new regulation include:

- Registration must be completed within 30 days of signing or renewing an employment contract
- In case of contract termination or removal, registration must be completed in seven days
- Employers filing false information or failing to register may be prosecuted by the government

The law, especially designed for rural migrant workers, aims to protect the interests of employees and prevent illegal employment in the country, according to the Xinhua News Agency. Further, to facilitate labor information exchange, the government aims to put in place a registry system and jobs database by the end of 2008.
