Russia: Changes to labor code come into effect 3 October 2016

On 3 October 2016, changes to the Russian Labor Code will come into force as follows:

- A provision that a salary payment date (which must be no later than 15 calendar days after the final day of the period for which salary is accrued) must be set by internal labor regulations, a collective agreement, or an employment agreement.  This supplements the rule under the current Labor Code which requires salary payments to be made at least twice a month;

- An increase in the limitation period for employees to claim salaries and other employment related payments due to them.   Employees now have 1 year (rather than 3 months) from when they learn of the violation of the their rights to bring a claim;

- Increased liability and fines for late payment of salary and other employment related payments;

- Enhanced sanctions and fines for labor law violations and for non-payment which can include a general director being disqualified from holding a management position.

Employers should review existing employment contracts and policies (eg internal labor regulations) to make sure that a salary payment date in the relevant HR documents is no later than 15 calendar days after the final day of the period for which it is accrued.
